Opportunity and risk management using the example of the LkSG

A holistic risk management system is the basis for sustainable and efficient corporate management. In addition to the company's own circumstances, attention must also be paid to legal regulations. One example of this is the Supply Chain Duty of Care Act.

The challenge

Compliance and legal regulations represent an ongoing challenge for business processes and therefore also affect the software solutions involved. The high adaptability of these solutions therefore also lies in the possibility of flexible, modular additions for new circumstances (such as changes in legal regulations).

A current example of this is the Supply Chain Due Diligence Act (LkSG).

The Supply Chain Due Diligence Act aims to regulate corporate responsibility for compliance with human rights in supply chains for the first time. The law will come into force on January 1, 2023 for companies that employ at least 3,000 people and are based in Germany. From January 1, 2024, it will also apply in a second stage to companies with 1,000 or more employees.

One of the core elements of the LkSG is the introduction of risk management in order to identify, avoid or at least mitigate the risks of human rights violations and environmental damage along the entire supply chain.

The solution

An LkSG module was added to the existing opportunity and risk management software antares RiMIS® with the help of nedyx®. It consists of a questionnaire to assess the risks of supply chains and evaluations of the answers and results in antares RiMIS®. Companies can have this questionnaire completed by their suppliers and then find all the information collected in antares RiMIS®. New risks can thus be identified and further measures recommended on this basis.
